SpanishOnTheGo ("SpanishOnTheGo," "SOTG," "we," "us," or "our") respects your privacy. This Privacy Policy explains how we collect, use, share, and protect personal information when you visit our website, contact us, request information, enroll in lessons, or otherwise interact with our Spanish instruction services (collectively, the "Services").
By using our Services, you agree to the practices described in this Policy. If you do not agree, please do not use our Services.
1. Who We Are
SpanishOnTheGo is a Spanish language instruction service operating in Illinois and serving clients across the United States.

2. Information We Collect
We collect information you give us directly, information collected automatically when you use our Services, and information from third parties.
2.1 Information You Provide

Identity and contact information: name, email address, phone number, mailing address, and preferred language.

Account and scheduling information: lesson preferences, proficiency level, learning goals, availability, and time zone.

Payment information: billing name, billing address, and partial payment card information. Full payment card numbers are processed and stored by our payment processor (Stripe) and are not retained by SpanishOnTheGo.

Communications: the content of emails, text messages, voicemails, intake forms, surveys, and support requests you send us.

Lesson content: documents, assignments, written work, audio recordings (if applicable), and other materials you submit during the course of instruction.

Marketing preferences: subscription status for newsletters, promotions, and updates.
2.2 Information Collected Automatically
When you visit our website or interact with our digital communications, we and our service providers may automatically collect:

Device and browser data: IP address, browser type, operating system, device type, screen resolution, and language settings.

2.4 Audio and Video During Live Lessons
Live lessons may be conducted through third-party platforms (such as Zoom or Google Meet). Audio, video, and chat content during lessons are processed by those platforms under their own privacy policies. SpanishOnTheGo does not routinely record live lessons. If a recording is requested or required for instructional purposes, you will be notified in advance and asked for explicit consent. Illinois residents should also see Section 11 regarding biometric information.
3. How We Use Your Information
We use the information we collect to:

4. Legal Bases for Processing (for EEA/UK Visitors)
If you are located in the European Economic Area or the United Kingdom, we process your personal information based on one or more of the following legal bases:

5. How We Share Information
We do not sell your personal information for money. We share information only as described below.

Service providers: companies that perform services on our behalf, including payment processing (Stripe), email delivery, scheduling software, customer relationship management, web hosting, analytics, and advertising. These providers are contractually limited to using your information only to provide services to us.

Live lesson platforms: if you attend live lessons via Zoom, Google Meet, or similar, your interactions on those platforms are also governed by their privacy policies.

Advertising partners: Google, Meta, and similar platforms receive limited information for the purposes of measuring and improving our advertising. See Section 7.

Legal and safety reasons: when required by law, subpoena, court order, or government request, or when we believe disclosure is necessary to protect rights, property, or safety.

Business transfers: in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, information may be transferred as part of the transaction. We will notify you of any such change in ownership or control.

With your direction or consent: in any other case where you ask us to share information with a third party.
For purposes of the California Consumer Privacy Act (CCPA/CPRA), our use of advertising and analytics cookies may be considered "sharing" of personal information for cross-context behavioral advertising. See Section 10 for your rights and how to opt out.
6. Data Retention
We retain personal information only as long as needed for the purposes described in this Policy or as required by law.

Active client records: retained for the duration of the client relationship plus seven (7) years for tax, accounting, and legal compliance.

Lead and inquiry data: retained for up to twenty-four (24) months from last contact, unless you ask us to delete it sooner.

Marketing list data: retained until you unsubscribe or request deletion.

Website analytics data: retained according to the default retention setting of our analytics provider (typically 14 to 26 months).

Backups: information in routine backups is retained for up to ninety (90) days after deletion from active systems.
7. Cookies and Tracking Technologies
Our website uses cookies and similar technologies (pixels, tags, local storage) for the following purposes:

We honor Global Privacy Control (GPC) signals where required by law as an opt-out of "sale" and "sharing" for advertising purposes.
8. Marketing Communications and CAN-SPAM
If you receive marketing email from us, you may opt out at any time using the unsubscribe link in the email or by emailing privacy@spanishonthego.com. We will honor unsubscribe requests within ten (10) business days, as required by the CAN-SPAM Act. Even if you unsubscribe from marketing, we may still send you transactional communications related to your account, scheduling, payments, or service updates.
If you receive an unsolicited business-to-business outreach email from us, the email will identify SpanishOnTheGo, include a valid physical mailing address, and offer a clear way to opt out. We will not contact you again for marketing purposes after you opt out.
9. Data Security
We use reasonable administrative, technical, and physical safeguards to protect personal information against unauthorized access, disclosure, alteration, and destruction. These measures include encryption in transit, access controls, vendor due diligence, and limited staff access on a need-to-know basis.
No method of transmission or storage is 100% secure, and we cannot guarantee absolute security. If we become aware of a security incident affecting your personal information, we will notify you and applicable regulators as required by law, including the Illinois Personal Information Protection Act.
10. Your Privacy Rights
Depending on where you live, you may have some or all of the following rights regarding your personal information:

Deletion: request that we delete your personal information, subject to legal exceptions.

To exercise any of these rights, email privacy@spanishonthego.com with the subject line "Privacy Request." We will respond within the time required by applicable law, typically within 45 days. We will verify your identity before fulfilling a request. You may use an authorized agent to submit a request on your behalf where allowed by law. We will not discriminate against you for exercising your privacy rights.
California residents: you have specific rights under the CCPA/CPRA, including the right to know the categories and specific pieces of personal information collected, the categories of sources, the business or commercial purpose, and the categories of third parties with whom we share information. The categories above describe our practices in the preceding 12 months.

11. Illinois Biometric Information Privacy Act (BIPA) Notice
We do not routinely collect, capture, purchase, or otherwise obtain biometric identifiers or biometric information (such as voiceprints, faceprints, or scans of hand or face geometry) from clients.
If, in the future, any feature of our Services would involve the collection or use of biometric identifiers, we will (a) provide you with written notice of the specific purpose and length of time for which the data will be collected, stored, and used, (b) obtain your written release before collection, and (c) maintain a publicly available written policy establishing a retention schedule and guidelines for permanently destroying biometric identifiers, all in accordance with BIPA, 740 ILCS 14/.
Note that any voice or video captured by third-party platforms during live lessons (Zoom, Google Meet, etc.) is handled under those platforms' privacy policies. We do not extract biometric identifiers from such content.
12. Children's Privacy
Our Services are intended for adults age 18 and over, and for minors only when their parent or legal guardian has enrolled them and provided verifiable consent.
We do not knowingly collect personal information from children under 13 without verifiable parental consent. If you are a parent or guardian and believe your child under 13 has provided us with personal information without your consent, please contact us at privacy@spanishonthego.com and we will delete it.
For minors between 13 and 17 who are enrolled by a parent or guardian, we limit data collection to what is necessary for instruction, and we will honor parent/guardian requests to access, correct, or delete the minor's information.
13. Third-Party Links and Services
Our website and communications may contain links to third-party sites and services. We are not responsible for the privacy practices or content of those third parties. We encourage you to review their privacy policies before providing any personal information.
14. International Data Transfers
We operate in the United States. If you access our Services from outside the United States, your information will be transferred to, stored in, and processed in the United States, which may have data protection laws different from those in your country. By using our Services, you consent to this transfer where permitted by law.
15. Do Not Track
Some browsers offer a "Do Not Track" (DNT) signal. There is currently no industry standard for responding to DNT signals, and our website does not respond to them. However, we do honor Global Privacy Control (GPC) signals where required by law.
16. Changes to This Policy
We may update this Privacy Policy from time to time. The "Last Updated" date at the top reflects the most recent revision. Material changes will be communicated through our website or by email where appropriate. Your continued use of the Services after a change takes effect constitutes acceptance of the updated Policy.
